I recently posted about the government's appeal to prevent a Scottish court referring to the ECJ for a ruling on whether the UK can withdraw Article 50 (HERE). Their appeal was to the UK Supreme Court but yesterday the QC behind the case tweeted:
The Supreme Court has refused the Government's request for a hearing on the Article 50 case. It will instead determine the Government's application for permission to appeal on the papers during the course of next week. https://t.co/Xbhvvu4cud— Jo Maugham QC (@JolyonMaugham) November 15, 2018
I confess I'm not sure exactly what it means. I think the SC has turned down the request for an appeal but will examine the government's grounds to determine if the appeal can go ahead.
Apart from all the other problems Mrs May has, this case would add another if it goes against them and always assuming the ECJ rules Article 50 can be unilaterally revoked.
