Trump's lawsuit is a self made disaster for the president

The BBC’s US legal team, in the defamation suit Trump filed in Florida a few days ago, has put the knuckledusters on. The unstable 'genius' has jumped out of the frying pan into the fire while simultaneously shooting himself in both feet. There will soon be his most humiliating climb down ever, heavily disguised as magnanimity or a great win. But it will be a massive climb down without a doubt. The Mirror has the story of how the corporation’s lawyers will be demanding discovery (the handing over of documents, messages, phone records, etc) about what he was doing around 6 January 2021.They will also depose him, that is get him to face questions under oath, even before the case gets to court.

And then, if it ever gets to court, he’s going to be on the witness stand to face questions about what happened, what he did and who else was involved.  And there is a mountain of evidence that he was at the centre of it and actually instigated the 6 January 2021 attack on the Capitol.

Never forget that no attorney that Trump has ever employed has ever dared allow him to give evidence in court under oath. I’ve listened to him give evidence in a deposition, and he struggles, having to consult his lawyer on every point before answering and being unbelievably evasive, or refusing to answer, repeatedly pleading the 5th amendment.

"A source close to the case told the Mirror: 'The moment Trump filed this case, he opened the door. He thinks he can attack the BBC for $10bn. But he could expose himself to questioning that could finally pin down what he did, what he knew and when'."

I imagine the BBC’s legal representatives can’t wait to get him in open court, on his own, in front of a judge and jury. It would be spectacularly damaging to him, and that’s why it won’t happen. The laws on perjury still apply even to a president with immunity for official acts, as granted by the Supreme Court.

And this comes as pressure mounts on him to release all of the Epstein files, with minimal redactions. On Friday, we only saw about 1% of what the FBI has, and some Grand Jury transcripts had been entirely redacted!!

Trump isn’t going to face all that in 2026, especially not as the Epstein scandal threatens to engulf him.

Up to now, he has made millions by threatening US broadcasters for $billions. They then quickly concede out of court and negotiate a settlement, like Trump is a Mafia boss. The BBC is a public body. They cannot simply spend millions satisfying the stupid demands of Trump.

The Mirror report says:

"The BBC will be preparing discovery demands requiring Mr Trump to turn over internal communications about the Panorama episode, as well as emails, memos, drafts and briefing notes covering January 6. Every answer, every document, every sworn statement would be legally binding, with perjury charges looming over any falsehood. 

"Our source added: 'If Trump wants billions, he’s going to have to pay for it in disclosure. He’s never faced questioning like this. The evidence demands will be relentless. No one has ever been able to pin Trump down on his movements during the riot. 

"If the BBC’s legal team deposes him, that changes. They’ll have him answering for every minute'.”

Imagine that happening. You can't, can you?

He even pleaded the 5th when asked if he was president of The Trump Organisation, his own business, which was a matter of public record at the time!!

In civil proceedings, the judge and jury can draw adverse inferences if the defendant or plaintiff declines to answer reasonable questions. He answers NONE!

No, Trump is never going to allow the BBC case to get much further, and certainly not to court. He'll delay and delay and delay while desperately figuring out how to get himself off the hook he's caught himself on. The BBC should play this for all it's worth and watch him wriggle and twist for months.
