The Wolchover case is moving towards a much higher public profile. You may remember David Wolchover claimed the Article 50 notification was illegal since there has been no constitutional decision made about leaving the EU, as The Supreme Court ruled was required last year. There are now three cases about to start in the courts all based on his proposition. He has now prepared an update that you can read (HERE).

THE WOLCHOVER LETTERS
The Wolchover Action Group (HERE) have been busy sending letters to police forces all round the country alleging a crime has occurred. The crime of misconduct in a public office, the letters claim, was committed by the the prime minister in submitting the Article 50 notification when no constitutional decision has been lawfully made by parliament. These letters have been forwarded to Cressida Dick, Commissioner of the Metropolitan police and she is said to be considering them.

WOLCHOVER - STILL RUMBLING ON
I have posted a couple of times about the Wolchover Action Group (HERE) who are looking at litigation to stop Brexit. They have updated the legal case (HERE) which I must say looks more attractive and compelling each time I see it. The group was urging members and others to write a template letter to the police, copy to their MP and the press, alleging a crime has taken place and Article 50 was triggered unlawfully.

WOLCHOVER CALL TO ACTION
Some time ago I posted an item about a lawyer's argument that there was no legal basis for assuming that Article 50 had been properly invoked, that parliament has never taken a decision to leave the EU (HERE). At the time the legal argument looked sound (but then to me a lot of things do!) but I believed it would take a court case to decide it.

A LEGAL HAND GRENADE?
A lawyer, David Wolchover, has prepared a legal argument (HERE) that suggests there are good grounds for believing the Article 50 notification was not legal. Let me say at the outset I am not a lawyer so my opinion means nothing but the arguments he puts forward look compelling. If I can summarise, the essence of it is this.
